7-Eleven ends lawsuit against Nike over shoes with store's colors
NKE•7-Eleven moved to dismiss with prejudice its trademark lawsuit accusing Nike of copying the chain’s orange, green and red stripes on an Air Max 95 shoe. The case cannot be refiled; whether the dispute was settled was not clear from the filing.
1. Lawsuit dismissal
7-Eleven told a Dallas federal court it would dismiss its trademark lawsuit accusing Nike of copying the chain’s orange, green and red stripe design on a pair of Air Max 95 shoes. On Monday, 7-Eleven moved to dismiss the case with prejudice, meaning it cannot be refiled.
2. Original allegations
7-Eleven sued Nike on July 2, seeking to block sales of the sneakers, which were set for release on July 11, or “7-Eleven Day.” The chain alleged that Nike designed the shoe to evoke its stores and that consumers could mistakenly believe it was sponsored or endorsed by 7-Eleven. Nike did not respond to the allegations in court.
