Alpha Modus wins US court denial of motion to dismiss in patent infringement case
AMOD•Alpha Modus said courts denied multiple motions to dismiss in its subsidiary’s patent infringement cases, including motions by MNTN, 7-Eleven, Lowe’s, Kroger, Johnson Controls and Sensormatic.
1. Dismissal motions denied
A Western District of Texas judge denied MNTN’s Section 101 motion to dismiss on Aug. 21, 2026. Eastern District of Texas orders on Sept. 29 and 30, 2026, rejected dismissal bids by 7-Eleven, Lowe’s, Kroger, Johnson Controls and Sensormatic, and denied Creative Realities’ venue challenge, keeping the cases in that court.
