Amsterdam District Court dismissed Shell’s damages claim in full against Clariant and three other defendants tied to a 2020 competition-law infringement.
The ruling found that Shell suffered no harm attributable to Clariant’s conduct, backing Clariant’s argument that the conduct had no market effect.
Related declaratory-liability claim also rejected
The court also rejected a related declaratory-liability claim filed by Stichting Ethylene Claims over the same conduct.
Clariant said it plans to keep defending the remaining proceedings in the Netherlands and Germany.
