Delta Air Lines must face lawsuit over 'window seats' that have no windows
DAL•A federal judge rejected Delta Air Lines’ request to dismiss a lawsuit by passengers who say they paid extra for window seats but were seated beside windowless walls. The judge found a reasonable dispute over whether Delta’s contract required it to provide the seats, without deciding the lawsuit’s merits.
1. Case moves forward
U.S. District Judge Ramon Reyes in Brooklyn rejected Delta Air Lines’ request to dismiss the lawsuit, finding a reasonable dispute over whether its contract of carriage required the airline to provide window seats to passengers who paid for them. The ruling did not decide the case’s merits.
2. Passengers seek damages
Four plaintiffs say they paid extra for window seats on Boeing 737, Boeing 757 and Airbus A321 planes but sat beside blank walls, and that the lack of windows was not disclosed during booking. The proposed class action seeks millions of dollars in damages on behalf of more than 1 million passengers.
