Drugmaker Corcept seeks to bar ex-judge's views in Teva antitrust case
CORT•Corcept is seeking to exclude testimony from retired federal appeals court judge Kathleen O’Malley, who submitted an expert report for Teva in its antitrust lawsuit against Corcept. Teva claims Corcept monopolized the market for Korlym and seeks unspecified damages and a court order.
1. Corcept challenges testimony
In a court filing in California, Corcept argued that O’Malley offered no technical expertise and that her legal opinions could improperly sway jurors without helping them understand the facts. O’Malley’s report for Teva said Corcept had filed “sham” patent infringement cases.
2. Underlying antitrust claims
Teva sued Corcept in 2024, alleging it monopolized the market for Korlym, a treatment for Cushing's syndrome, and pursued bogus lawsuits to thwart competition from Teva’s generic version. Teva seeks unspecified monetary damages and a court order stopping the alleged anti-competitive conduct; Corcept has denied the allegations.
