EMPD•Empery Digital urged investors to back its nine director nominees at the Oct. 14, 2026 annual meeting amid an ATG Capital challenge.
Shareholders were told to vote “FOR” the company slate on the white proxy card, and to withhold support for ATG’s nominees.
The board attacked ATG’s bid as lacking a credible plan, citing a prior liquidation push and seeking $9.15 million reimbursement.
Empery Digital framed the contest as critical to its AI data center investment strategy, alongside partners including Hunt Properties.
Board and management ownership was cited at 21.2% as the company argued its shares undervalue the business.
