Exxon, others defeat consumer lawsuit over plastic recycling claims
XOM•A U.S. judge dismissed a lawsuit accusing Exxon, Chevron and other chemical producers of misleading consumers about plastic recycling, finding the plaintiffs had not shown they had standing to sue.
1. Judge dismisses case
U.S. District Judge Toby Crouse dismissed the lawsuit on Tuesday, saying the plaintiffs failed to show standing and that their complaint did not connect the companies’ conduct to their injuries. He said it did not allege that any specific plaintiff saw marketing material from any specific defendant.
2. Claims and ruling
Eight individuals and a county commission board filed the 2024 lawsuit, alleging the companies misled consumers into believing plastic was broadly recyclable, prompting them to buy more plastic products. Crouse said manufacturers and retailers not named in the case set prices and that claims that the companies artificially inflated the cost of every plastic product the plaintiffs had purchased failed to account for intervening events and market conditions.
