1. FTC Finalizes Data-Sharing Order Against GM

The Federal Trade Commission has issued a final order prohibiting General Motors and its OnStar telematics unit from sharing precise geolocation and driving behavior data with consumer reporting agencies such as LexisNexis and Verisk. This action follows a 2024 New York Times exposé revealing that GM’s Smart Driver program, a free feature within its connected-car apps, collected data on braking patterns, seatbelt use and location, which brokers then sold to insurance firms—potentially influencing customers’ rates. Under the finalized terms, GM must obtain explicit, opt-in consent at the dealership before collecting, using or sharing any connected-vehicle data tied to a VIN. Exceptions allow sharing with emergency responders and anonymized data for internal research or urban planning partnerships, including work with the University of Michigan. Additionally, GM is required to deploy a consumer portal enabling U.S. drivers to access, export or delete their data and to disable precise location tracking on request. GM reports it has already updated its privacy disclosures, consolidated policy statements into a single document and overhauled its consent procedures in early 2024 to comply with these mandates.
