Google's use of press by AI chatbot may infringe copyright rules, EU court adviser says
An adviser to Europe's highest court said Google's use of press publications by its Gemini AI chatbot may infringe copyright rules in some circumstances. He said copyright-protected material may be used to train large language models under the text and data mining exception.
1. Copyright and chatbot answers
Advocate General Maciej Szpunar said a press publisher's rights may be infringed when an AI chatbot retrieves a publication, reuses it to generate an answer and provides that answer to a user. Copyright protects the specific form of expression, he said, but not the mere facts reported.
2. Case against Google
Szpunar was advising the court in a case brought by Hungarian website operator Like Company against Google. Opinions of the advocate-general are usually followed by the court's judges.
