GSK, Moderna settle patent dispute over Moderna COVID, RSV shots
MRNA•GSK and Moderna settled patent lawsuits over Moderna’s COVID-19 vaccines and RSV shot on October 28. The companies granted each other patent cross-licenses in infectious disease and are not required to make payments under them.
1. Patent dispute settled
GSK and Moderna settled lawsuits accusing Moderna’s Spikevax and mNEXSPIKE COVID-19 vaccines and mResvia RSV shot of infringing GSK patents. The companies said they granted patent cross-licenses in the field of infectious disease, with no payments required in connection with the licenses.
2. Court dismissal sought
The companies asked a Delaware federal court to dismiss GSK’s U.S. infringement claims with prejudice, meaning they cannot be refiled. GSK sued Moderna in 2024 over lipid nanoparticle technology used to deliver messenger RNA in the vaccines; a separate GSK lawsuit against Pfizer and BioNTech remains ongoing.
