Halozyme wins Dutch injunction blocking Merck Keytruda SC in eight European markets over EP622 patent
HALO•A Dutch court issued an injunction barring Merck from manufacturing, selling, importing or stocking Keytruda SC in eight European markets, finding infringement of Halozyme’s EP 2,797,622 patent and rejecting Merck’s invalidity challenge.
1. Dutch court injunction
The Hague court’s order targets Merck’s European authorization holder, MSD BV, and restricts use of its marketing authorization to support affiliates. Keytruda’s intravenous version remains available and is not covered by the injunction. Halozyme is also pursuing enforcement in Germany, where it won a preliminary injunction in December 2025, and in U.S. litigation.
