The tribunal found plausible due process and fair treatment rights for NORI and TOML, citing a real, imminent risk of irreparable harm.
ISA must follow the legal framework on due process, give procedural clarity, share key questions, and allow meaningful responses within a reasonable period.
The order also directs ISA to apply due-process requirements when considering NORI’s exploration contract extension request.
Both sides were told to cooperate and refrain from steps that could aggravate the disputes pending a final decision.
