New York Sues DuPont Over PFAS, Seeks Cleanup Funding and Profit Disgorgement
DD•New York Attorney General filed suit accusing DuPont and peers of decades-long concealment of PFAS toxicity, citing internal research since the 1970s. The complaint seeks to force companies to finance statewide PFAS cleanup, warn consumers, cease misleading PFAS marketing and pay damages, restitution and disgorgement of profits.
1. Lawsuit Filing
New York filed suit against DuPont, 3M, Chemours, Corteva and EIDP alleging they manufactured, marketed and sold PFAS chemicals despite knowing their toxicity. The complaint targets products including non-stick cookware, stain-resistant fabrics and food packaging and seeks court orders for cleanup funding and consumer warnings.
2. Allegations and Evidence
The complaint alleges internal company research dating back to the 1970s documented PFAS persistence and health risks, including links to cancer, birth defects and hormone disorders. It charges that companies concealed these findings from regulators and continued selling 'forever chemicals' and harmful substitutes.
3. Financial and Regulatory Impact
The suit demands that the defendants pay damages, restitution and disgorgement of profits and fund statewide PFAS cleanup efforts, potentially exposing them to multibillion-dollar liabilities. It also seeks injunctions to halt misleading advertising and mandate clear risk warnings and product labeling changes.
