NLRB tosses case against Tesla over workplace IT policies
TSLA•The National Labor Relations Board dismissed a complaint accusing Tesla of using restrictive IT rules to thwart union organizing at its Buffalo plant. The board upheld a judge’s decision that the rules, including a ban on workers having phones, protected confidential information.
1. Board upholds dismissal
The National Labor Relations Board on Wednesday summarily upheld an administrative law judge’s decision to dismiss a 2024 complaint accusing Tesla of trying to thwart union organizing at its Buffalo, New York, assembly plant through restrictive IT rules. The judge found that Tesla’s policies, including barring workers from having phones, validly protected confidential information.
2. Union challenged standard
The union argued that the judge should have applied a Biden-era test that made workplace rules easier to challenge, rather than a more business-friendly standard from President Donald Trump’s first term. The panel included David Prouty, the board’s lone Democratic member.
3. Other complaints
Tesla has faced a series of NLRB complaints but has prevailed in several, including claims that union supporters at the Buffalo plant were unlawfully fired.
