Olin to Take $75M Charge, Plans $185M Payout After Shintech Verdict
Following a jury verdict against Olin in Shintech v. Olin litigation, the company recorded a $75 million pre-tax charge in fourth quarter 2025 and will exclude it from adjusted EBITDA. Olin expects to pay approximately $185 million, including previously accrued reserves, during the first half of 2026.
1. Litigation Verdict and Charge
The jury returned a verdict in favor of Shintech on February 10, 2026, concluding a pricing dispute and force majeure dispute over a vinyl chloride monomer plant turnaround that began in April 2023. Olin Corporation and its subsidiary Blue Cube Operations LLC were found liable and must satisfy the judgment.
2. Financial Impact on Q4 2025 and Adjusted EBITDA
As a result of the verdict, Olin recorded a $75 million pre-tax, non-recurring charge in its fourth quarter 2025 consolidated financial statements. Management will exclude this one-time loss when calculating adjusted EBITDA for the period.
3. Cash Payment and Future Outlook
The company expects to pay approximately $185 million, including previously accrued reserves, during the first half of 2026 to satisfy the court’s decision. Olin is evaluating its legal rights and options following the verdict while maintaining that its actions complied with industry safety practices.
