Sanofi agrees to settle US antitrust case over diabetes drug Lantus
SNY•Sanofi reached an agreement in principle to settle a long-running US antitrust case over its Lantus diabetes treatment. The settlement terms are confidential, and Sanofi said it made no concession of liability.
1. Agreement in principle
Lawyers for drug purchasers told a federal judge in Boston that they had reached an agreement in principle with Sanofi, ahead of a trial scheduled for January. The plaintiffs included Cencora, Cardinal Health and McKesson, which alleged Sanofi’s conduct forced them to pay inflated prices for medications.
2. Patent listing claims
The plaintiffs alleged Sanofi improperly listed patents in the FDA’s Orange Book, delaying generic competition for Lantus until at least 2020. Sanofi said it maintains that claims its conduct delayed competition for Lantus SoloStar pens are without merit.
