UTHR•A Delaware federal court ruled that Liquidia’s Yutrepia infringed two claims of a United Therapeutics patent for PH-ILD use and rejected Liquidia’s bid to invalidate them. United Therapeutics plans to seek withdrawal of Yutrepia’s FDA approval and monetary damages, including a possible royalty on sales.
1. Court rules on patent claims
The Delaware federal court ruled that Liquidia’s Yutrepia infringed two claims of United Therapeutics’ U.S. Patent No. 11,826,327 covering PH-ILD use, and rejected Liquidia’s bid to invalidate the claims. United Therapeutics plans to seek an order directing the FDA to withdraw Yutrepia’s NDA approval, potentially removing it until its labeling drops PH-ILD. The company also intends to pursue monetary damages for past infringement, including a possible royalty on Yutrepia sales.
