US judge pauses discovery on NY Times' retaliation claim against EEOC
NYT•A Manhattan judge paused evidence gathering on the New York Times' claim that the EEOC retaliated against it, pending a decision on the commission's motion to dismiss. Discovery in the EEOC's underlying discrimination lawsuit can proceed.
1. Discovery paused on counterclaim
US Magistrate Judge Robyn Tarnofsky paused discovery on the Times' claim that the EEOC violated its constitutional rights by suing the newspaper, saying the commission's motion to dismiss should be decided first. She said the EEOC had made “substantial arguments” in defense of its lawsuit.
2. Underlying lawsuit continues
The EEOC sued in May, accusing the Times of race and sex discrimination in pursuit of its diversity goals. The Times' countersuit says it was targeted for coverage critical of President Donald Trump's administration. Discovery in the commission's lawsuit can continue.
