Vertical Aerospace filed a patent infringement counterclaim against Archer Aviation on Oct. 6, alleging its Midnight eVTOL infringes a U.S. patent and seeking an injunction and monetary damages.

1. Counterclaim filed

Vertical Aerospace filed the counterclaim in U.S. federal court in Texas, alleging that Archer’s Midnight eVTOL infringes one or more claims of Vertical’s U.S. Patent No. 12,747,027. The filing was lodged in a lawsuit Archer brought against Vertical and a wholly owned unit on Feb. 23, 2026.
