CNMC launches disciplinary proceedings against Apple and Amazon
AAPL•Spain’s CNMC launched disciplinary proceedings against Apple and Amazon, saying they failed to comply with a 2023 cease-and-desist order. The order concerned anti-competitive clauses in contracts governing Amazon’s role as an Apple distributor; the watchdog has up to three months to investigate and resolve the case.
1. Proceedings launched
Spain’s competition watchdog CNMC launched disciplinary proceedings against Apple and Amazon, saying the companies failed to comply with a cease-and-desist order imposed in a July 2023 sanctioning resolution. That resolution fined both companies over anti-competitive clauses in contracts governing Amazon’s role as an Apple distributor.
2. Appeals pending
CNMC said the 2023 penalty decision and a 2025 decision on non-compliance have both been appealed to Spain’s National High Court and are pending judgment. It said the companies did not take measures to comply until May 2025, and that up to three months is now allowed for the investigation and resolution.
