ParkerVision says Federal Circuit remands Qualcomm patent case to Florida district court
PRKR•ParkerVision said the Federal Circuit remanded its patent case against Qualcomm to a Florida district court after dismissing an appeal for lack of jurisdiction. The company plans to pursue a jury trial on transmitter patent claims seeking about $440 million in damages.
1. Case returns to district court
The Federal Circuit dismissed ParkerVision’s appeal for lack of jurisdiction and remanded the case to the Middle District of Florida, leaving the receiver-claim construction issue unresolved without reaching its merits. ParkerVision plans to pursue a jury trial on transmitter patent claims, seeking about $440 million in damages, and said it will preserve its right to appeal the receiver-claim construction after a final district court ruling in the transmitter case. The appeals court also denied ParkerVision’s request to reassign the case to a new district judge.
